According to Section 410 of the Local Government Act (2015/84), certain municipal elected officials and office holders must declare their interests to the Audit Board, which will notify the municipal council of the declarations. The declarations are published on the municipality’s website. The declaration of interests must be made within two months of the person being elected to their position of trust or duty. Persons subject to the declaration obligation are obliged to notify of changes and to correct incorrect information.

Declarations of affiliation

Those required to report

The elected officials subject to the notification obligation are the members and deputy members of the municipal government, the chairman and deputy chairmen of the municipal council, and the chairmen and deputy chairmen of committees (including the Central Election Committee). The notification obligation applies to members and deputy members of the institution performing the tasks referred to in the Land Use and Building Act (Merikarvian municipality technical committee). In addition, the reporting obligation applies to the chairmen of the sections (Merikarvian in the municipality, the welfare department). Of the office holders, the reporting obligation includes the municipal government, committees and the department's rapporteurs. The reporting obligation applies only to the personal interests of the relevant elected official or office holder. The obligation therefore does not apply to memberships or ownership of close persons.

Disclosure of affiliations

A declaration of affiliation must be made regarding the management positions and positions of trust of a trusted person or official in companies and other entities engaged in business activities. In addition, a declaration must be made regarding significant assets and other affiliations that may be relevant to the performance of positions of trust or official duties. Not all affiliations are relevant to the performance of a position of trust or official duty. The matter is decided on a case-by-case basis. For example, information related to leisure activities may not be relevant.

In this context, business activity refers to business and professional activities. The reporting obligation includes management positions in a company or other entity, i.e. at least the positions of the CEO and deputy CEO. Positions of trust refer to membership in the bodies of an entity or company, i.e. most importantly, membership of the company's board of directors, supervisory board or equivalent body.

Significant assets can be considered to mean, among other things, significant ownership of real estate or shares in a housing company. The connection of assets to business or investment activities can be considered as a guideline for interpretation, so for example, mere ownership of shares in one's own apartment is not subject to the reporting obligation. In principle, ownership of real estate that is located in one's own municipality or in an area that is the subject of decision-making may be significant. In some cases, ownership of land and forests in one's own municipality may be significant in the performance of positions of trust and office. In a specific case, ownership of shares in real estate companies or other shareholdings may be considered significant in the performance of positions of trust. Partnerships and ownerships related to a profession may also be significant in the performance of positions of trust and office. On a case-by-case basis, significant debt and a commitment given on behalf of a third party (e.g. a guarantee or surety) may also be relevant in the performance of duties of trust or office, especially if the debt is related to business activities.

A person's association and foundation activities may also be relevant in assessing the impartiality of municipal decision-making. The obligation to disclose applies to information that can be objectively assessed as potentially relevant to the performance of positions of trust or official duties.
